This Site is owned and operated by Northern California Retired Officers Community, a California nonprofit public benefit corporation doing business as Paradise Valley Estates (“Paradise Valley Estates”, “we”, or “us”). We are committed to protect the privacy, confidentiality, and security of the personal information (defined below) that we receive. We take your privacy and your trust in us very seriously. This Privacy Policy describes the principles and practices that apply to the personal information that we collect from individuals online or offline (“you”), such as individuals who browse through the Site, register on the Site, use the services provided on the Site, interact with the Site, communicate with us through telephone, email, text, or other communications means, participate in our interviews, surveys, or promotions, read or receive our newsletters, or apply for employment with us.

About This Privacy Policy

This Privacy Policy applies when you visit or use our Site, apps and/or services. This Privacy Policy may be supplemented by additional privacy statements, terms or notices provided to you. We will indicate within the registration processes of services and other registration forms what types of personal information are required and those that are requested. You may choose not to submit the requested information, but that may limit or prohibit the services that we are able to provide to you.

Your Agreement to this Privacy Policy

By creating an account, using the Site, and/or submitting personal information to us, you agree to the practices described in this Privacy Policy, and you agree that we may collect, use, disclose, store, transmit, and/or process such personal information in accordance with this Privacy Policy or as required by law.

The Site and the services are targeted at users in the United States of America. The personal information that we collect is sent to and processed on servers located in the United States. Such transfer is necessary to process the information and provide the Site and services. The data protection laws of the United States or other countries may not be as comprehensive or equivalent to those in your country of residence. Paradise Valley Estates recognizes the privacy interests of children, and we encourage parents and guardians to take an active role in their children’s online activities and interests. Neither the Site nor our services are intended for children under the age of 16. Paradise Valley Estates does not target its services or the Site to children under the age of 16. Paradise Valley Estates does not knowingly collect personally identifiable information from children under the age of 16. Should we discover that a child under the age of 16 has sent personal information directly to us, we will use that information only to respond directly to that child to inform him/her that we will not continue to process his/her personal information.

The Site may provide links to other websites or resources over which Paradise Valley Estates does not have control (collectively, “External Websites”). Such links do not constitute an endorsement by Paradise Valley Estates of those External Websites. You acknowledge that Paradise Valley Estates is providing these links to you only as a convenience, and further agree that Paradise Valley Estates is not responsible for the content of such External Websites. Your use of External Websites is subject to the terms of use and privacy policies located on the link to External Websites. We recommend that you read the privacy statements that are posted on these External Websites to understand their procedures for collecting, using, and disclosing personal information.

What Personal Information We Collect and How
For purposes of this section “personal information” means information that identifies, relates to, describes, is capable of being associated with, or could be linked, directly or indirectly, with a particular consumer or household. Personal information does not include:

• Information that is lawfully made available from Federal, state, or local government records.
• De-identified or aggregated information; and
• Information excluded from the scope of the California Consumer Privacy Act of 2018, as amended

(“CCPA”), such as health or medical information covered under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and financial information covered under the Fair Credit Reporting Act (“FCRA”) or Gramm-Leach Bliley Act (“GLBA”).

We may have collected and disclosed the following categories of personal information in the preceding 12 months:

As discussed further below, the following are some of the sources for the various categories of personal information we collect: our consumer service products, prospective residents, residents, business partners and prospective business partners. We describe below the different ways in which we collect or obtain personal information. We use the personal information (identifiers, customer records information, commercial information, biometric information, internet or other electronic network activity information, geolocation data, and sensory information) for the following business and/or commercial purposes: providing services to residents, supporting client services to consumers, advertising, marketing, and our internal operations.

While we may disclose your personal information for the business purposes set forth in this Privacy Policy, Paradise Valley Estates does not sell your personal information to third parties.

If you visit the Site — If you visit the Site, we automatically collect the related Session Data (defined below). Session Data is provided to us by your browser, by third-party integrations on our Site, and through our log files, which record your activities while browsing our Site, such as when you click on a link. We may record some of this data in one or more cookies that we send to your browser (see “Cookies and Other Online Technologies”). In certain sections of the Site, we may also require you to submit your personal information to us, and we may invite you to submit questions, comments, and request information.

“Session Data” means, as applicable, usage information, such as IP address, unique identifier of an individual’s mobile device, the type of browser, type of operating system, referring URL, date, time and duration of a visitor’s visit, the number of visits to a Site, the pages viewed, order of pages viewed, time spent on a particular page, the number of cookies accumulated, bytes sent, bytes received, protocol version, user agent, method, URI stem, URI query, or MAC address.

If you register or create an account — If you register or create an account, we require that you provide certain personal information during account registration. We collect your name, email address, contact information, and other information, and may ask you for other optional information that helps us serve you better.

If you complete a reservation form or indicate an interest to become a resident – We also may collect personal information about you if you are an individual potential resident and you complete a reservation form or indicate an interest to become a resident in a property of our senior living facilities (collectively, “Customer Data”).

We may use your personal information to verify your authority to enter certain password- protected areas of the Site, verify that you are a resident or prospective resident, send you information that you have signed up to receive, notices about our services that you have used or that may be of interest to you and notices about events and improve the content and general administration of the Site and our services. If you are a potential resident or resident of our senior living facilities, we may use your Customer Data and/or personally identifiable information, including your credit card information, to reserve an apartment unit for you pursuant to your request.

If you subscribe to our services or you engage with our social media features – We also may collect any personal information and other information if you subscribe to our other services and you engage with our social media features (“Social Media Communications”). Due to the nature of some of our services, you may provide us with personally identifiable information such as your name, email address, username, password, company name, website name, address, phone number, and other contact information that you voluntarily transmit in your communication to us or that you include in your Social Media Communications. If you are a potential resident of our senior living facilities, we may also collect your credit card number and information. If you are a client of our services, we will collect billing information and the features and amenities of your property. If you engage with our social media features, we may collect your contact information and login credentials (such as username, password, and PIN) for third-party websites so our services can integrate with Facebook, Twitter, GoDaddy, Google Places, etc. If you post to our blogs, we may collect any other personally identifiable information that you include in your posting. If you post to our blogs, other users of the Site will be able to see your posting and any other personal information you include in your posting.

We collect Customer Data and/or personal information from you and from other categories of sources such as: our affiliates, our residents, public and publicly available sources, our third-party resellers and referral partners, data suppliers and service providers, partners with which we offer co-branded services or engage in joint event or marketing activities, social networks, news outlets and related media, and the organization with which you are employed or affiliated.

If you participate in a survey — If you choose to participate in one of our surveys, we may collect personal information such as your name, email address, and any other personal information that you may provide in your survey responses. Participation in surveys is optional, and we give you the ability to opt out of being contacted for surveys at any time.

If you sign up to receive marketing communications — If you sign up to receive our marketing communications, we may collect information on the open rate of the communications, and whether a specific individual has clicked on a link contained in a particular communication. Our marketing communications contain instructions on how to opt out of receiving future marketing communications if you no longer wish to receive them.

If you are a resident, prospective resident or other business contact — If you are a resident or prospective resident of our senior living facilities or other business contact, or if you are an employee or agent of a resident, prospective resident or business contact, we may collect your name, email address, telephone number, and other contact information in the regular course of our interaction with you. We may obtain personal information about you from the organization with which you are employed or affiliated if you access our services through your organization.

If you interact with third parties regarding our services — We may receive personal information about you from third parties, such as from residents, prospective residents, websites where we advertise, business partners, and service providers. Some of this information pertains to a specific individual; other information can only be linked to an access point or a device.

If you use our mobile application — We may collect certain additional personal information from you, including your location information. We may also collect personal information relating to your third-party contacts, including any additional information you choose to add regarding such contacts, but only if you choose to make use of the app’s feature(s) that require or utilize this information.

We collect only such personal information as necessary to (a) provide our services to you; (b) inform you about our services; (c) continue our research in the field; and (d) improve our Sites, our services, and your experience interacting with us.

How We Use personal information

We may disclose personal information to: our affiliates, our residents, our service providers, agents and representatives, joint venture partners, distributors, referral partners and integrators; the administrators authorized by your organization (if you access our services through your organization), licensors of third-party applications (if you access a third-party application through our license agreement with the licensor), and other parties where required by law or to protect our rights.

We use personal information in order to provide and enhance the services that we offer as explained below:

To improve our services — We use personal information to provide services, and for analytics, market research and business development, including to operate and improve our Site, our services, associated applications and associated social media platforms.

We may provide your personal information and the data generated by cookies and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you. If you are a user of our services, we may provide your personal information to third parties at your request to provide additional functionality in and/or integrations with our services. Such third-party entities may be obligated to use your personal information solely to provide the services to us.

To facilitate the use of the Site — We use Session Data to ease navigation throughout the Site, to enhance navigation, keep track of login name and password in order to avoid requesting identity information when the visitor moves from page to page, and in general to enhance the quality of our Site and the content provided on the Site.

For research purposes — We may use aggregated Session Data to better understand how our Site is navigated, how many visitors arrive at specific pages, which pages or content attract more viewers, the length and frequency of stays at our Site, the different types of searches of our Site’s content and databases, the types of browsers and computer operating systems that our visitors use, and the IP addresses from which visitors connect to our Sites, in order to improve our Site and enhance our content. We may use IP addresses to gather broad demographic information—information that is not associated with any individual, and is therefore anonymous. We also use aggregated responses, demographic data, and other data to improve our services. We may use location information gathered from our mobile application(s) for research and development purposes.

For maintenance purposes — We may use IP addresses and Session Data to diagnose problems with our server, and to administer our Site.

For marketing purposes — We may use email addresses or other contact information to send mailings, newsletters, and other marketing communications regarding product information and releases. We may use your telephone number to contact you for marketing purposes. We may use pixel tags to monitor the open rate of our communications. This helps us understand the effectiveness of the communications that we send. We give you the ability to opt out of marketing communications at any time.

For survey analysis — The information that we collect through our surveys is not used other than to garner survey results and statistical analysis.

Usage Information

We automatically collect information about your interactions with the Site, including information about the device you use to interact with and/or access the Site, such as IP address, access dates and times, information about your approximate location (as determined through your IP address), hardware and software information, mobile, computer or hardware device information (e.g., operating system version, Hardware model, IMEI number and other unique device identifiers, MAC address, and device settings), device event information, and crash data. This information allows Paradise Valley Estates to understand how you have used the Site (which may include administrative and support communications with us or whether you have clicked on links to External Websites (defined below)), and other actions you have taken in connection with your use of the Site. We automatically collect log data when you access and use the Site, even if you have not created an account or logged in.

Aggregate Information

The Site may track the total number of visitors to the Site, the number of visitors to each page of the Site, browser type, IP addresses, External Websites linked to, and other aggregated data collected through our services and we may analyze this data for trends and statistics in the aggregate but such information will be maintained, used and disclosed in aggregate form only and it will not contain personally identifiable information. We may use such aggregate information to analyze trends, administer the Site, track users’ movement, and gather broad demographic information for aggregate use.

To Whom We Disclose Personal Information

From time to time, we may disclose personal information to someone other than the individual who provided the personal information, including consumers and residents, service providers, co-marketing and business partners, analytic providers, social media platforms, and/or government agencies as further described below:

Consumers and Residents — We provide certain consumers, including residents and potential residents, with the information that they need to properly use our Site and/or our services.

Service providers — We may engage certain third parties to perform functions and provide services to us, including, without limitation, customer relationship management, contract management, order fulfillment, mass mailing, hosting and maintenance, database storage and management, business analytics, and direct marketing campaigns. As of the effective date of this Privacy Policy, the current list of service providers to whom we disclose personal information is as follows:

• Financial institutions;
• Payment processors;
• Customer relationship management providers such as WelcomeHome CRM;
• Fraud detection providers;
• Data room or data transfer providers; and
• Cloud hosting providers.

Pursuant to written agreements between Paradise Valley Estates and these service providers, each of these service providers only has access to such personal information as necessary to fulfill its obligation to Paradise Valley Estates, is not permitted to use personal information for any purposes other than those directed by us, and is required to act in a manner consistent with the privacy principles articulated in this Privacy Policy and applicable law.

We also engage with the service providers of the residents of our senior living facilities.

To defend or enforce our rights — Paradise Valley Estates may use personal information to protect us or to protect the Site, to respond to a breach of our terms of service (or other applicable legal terms), to prevent fraudulent activity, or where it is necessary to pursue available remedies. If a resident or agent of a resident neglects to pay amounts due and owing to us, we may send that resident's name, contact information, and account information to a third-party service provider for collection of overdue payments.

We will disclose your personally identifiable information if we believe we are required to do so by law, regulation, or other government authority or to assist in any investigation, to protect our or our users' rights, or to enforce our terms of use.

Co-Marketing Partners — We may collaborate with other companies to offer you additional services. We may share personal information that is necessary for these other companies to provide the services that you have requested. This Privacy Policy does not cover the use of your personal information by these companies. We encourage you to read the Privacy Policy of such companies before requesting any of their products or services.

Mergers & Acquisition; Bankruptcy — We will not sell your personally identifiable information to any company or organization except we may transfer your personally identifiable information to a successor entity upon a merger, consolidation, or other corporate reorganization in which Paradise Valley Estates participates or to a purchaser of all or all of Paradise Valley Estates' assets to which the Site relates. If any or all of Paradise Valley Estates' assets are acquired by or merged with those of another entity, or in the unlikely event of a bankruptcy, we may disclose, share or transfer some or all of our users' personal information to or with this entity in preparation of the transaction, as part of the due diligence, or after the transaction has been consummated, so that the successor entity can continue providing our services to our residents and/or users. If the recipient of the personal information has privacy practices that do not meet the substance of this Privacy Policy, you will be given the opportunity to exercise your rights with respect to your personal information.

Law Enforcement; Litigation — Certain Federal, state, local, or other government regulations may require that we disclose information that we hold. In such cases, we will use reasonable efforts to disclose only the personal information required under applicable law, such as in response to a facially valid court order, warrant or subpoena issued or made by a court, person or body. We may use or disclose personal information (a) if we believe in good faith that a law, regulation, rule or guideline requires it; or (b) to a person who needs the information because of an emergency that threatens the life, health or security of an identified group or person.

Aggregated data — Other than as stated above, if Paradise Valley Estates provides a third-party with personal information, it will be in the form of aggregated data and used for product development, research, or statistical analysis. Aggregated data are created from records that are stripped of all personal identifiers.

Cookies and Other Online Technologies

When you access the Site, we, and the third-party companies we partner with may collect and store certain information by using technologies such as server logs, cookies, web beacons, clear gifs, tags, e-tags, flash cookies, pixels, code, Javascript packages, software development kits, and similar technologies. The information collected by these technologies includes information about your computer or mobile device and the network you use to access the Services, as well as information about your use of the Site.

We use both session ID cookies and persistent cookies. A cookie is a small text file that a website sends to a visitor's browser and that sends back information each time the visitor makes a request from the website. A cookie contains a unique identification number that identifies the visitor's browser, but not necessarily the visitor. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period. We use session cookies to make it easier for you to navigate the Site by saving your preferences and improving and tracking the overall Site experience. We set a persistent cookie to authenticate your login and authorization to use the services. Cookies can be accepted, rejected, or identified by configuring a browser's preferences or settings. If you reject cookies, you may still use the Site, but your ability to use some areas of the Site may be limited. Pixel tags or clear gifs are tiny graphics with a unique identifier that are embedded invisibly on a webpage and are used to track a visitor's movements on a website. We use the information gathered by clear gifs to help us better manage content on the Site. Cookies and pixel tags are used to help recognize a returning visitor, and to help customize the visitor's online experience. Unless a visitor specifically informs us of his/her identity (e.g., by registering with us), we will not know who the individual visitor is.

Depending on your activities on the Site and your settings on your browser, the information collected by us and the third-party companies may include software and hardware attributes of the device, device ID information, regional and language settings, performance data about the Site, network provider, IP address, browser or operating system type and version, demographic or inferred-interest information, search terms, the activities and actions taken on the site, as well as information you have submitted to us through the Site. Third parties may also receive additional information such as advertising IDs associated with you or your device.

In addition, we, and third-party companies we partner with, may collect and store some information in the form of log files that record website activity. For example, log file entries are generated every time a user visits a particular page or clicks an image on our Website, and collects information on how many "hits" a particular web page is getting (a.k.a. "click-through data"), the dates and times that you use the Site, the pages you visit, the amount of time spent on specific pages, and other similar usage information, and general data (including the name of the web page from which you entered the Site).

We may also use web beacons and other technologies to collect information about your interaction with our email communications. When you open or view the content of our emails, we and the third-party companies we partner with will receive information including confirmation that the email was viewed, the time that the email was opened, the IP address of the device that was used to open the email, the type of software used to read the email, and the existence of any cookies previously sent.

We, and the third-party companies we partner with, may use the information collected through all of these technologies to operate the Site, understand general usage and volume statistics, how users navigate to and around our Sites, what content is viewed or accessed, what searches were performed, the performance of our Site, to help us design our Site, to identify popular features, to resolve hardware and software problems, to make the Site more useful to visitors, to evaluate the effectiveness of our email communications, for marketing and advertising, and for security purposes. We may also use these technologies and the information collected to keep track of your preferences.

We may also use this information to allow third parties to provide analytics and advertising services to us and to serve advertisements to you on our behalf across the internet and in mobile applications. Third-Party Analytics Tools

Beyond the personally identifiable information you voluntarily provide to us, Paradise Valley Estates utilizes analytics tools, including third-party technologies, such as Google Analytics and Microsoft Clarity, to collect information using cookies. Certain types of information, including geolocation, device type, onsite website usage and behavior, demographic data, and purchase history, are collected and aggregated across the Site users for our analysis and advertising efforts.

Third-Party Advertising Tools

Paradise Valley Estates uses Google Ads, Google Analytics, and similar types of technologies to display relevant advertisements to users who have previously visited the Site. Referred to as remarketing or retargeting, Paradise Valley Estates may utilize previous Session Data to serve display advertisements to you on the Site, and based on such Session Data Google may set a cookie and serve ads to you on third-party websites on the Google Display Network. Third-party vendors such as Google may display Paradise Valley Estates ads on websites across the Internet. Aggregated user data may be utilized to create remarketing/retargeting "lists," or groups of users with similar onsite behaviors or demographics. Paradise Valley Estates also uses various Google tools to display advertisements to users based on their inferred interests and demographics.

Chatbot Technology

We use chatbots to help provide customer service and support, including through the use of a virtual assistant. A chatbot is a software application that mimics human conversations in text or voice interactions on our website or through our customer service hotline. It enables the communication between a human and a machine, which can take the form of messages or voice commands. The chatbot is designed to work without the assistance of a human operator. It responds to questions posed to it in natural language as if it were a real person using a combination of pre-programmed scripts and machine learning algorithms. When asked a question, the chatbot will answer using the knowledge database that is currently available to it. If you use our chatbot service, we will collect any personal information you provide to us. We will also create, record, and store a transcript of your chat interaction with us, which will be shared with and stored by our third-party service providers.

IP Address and Geolocation Information — When you submit information through forms on our Site, we automatically collect your IP address and the country associated with your IP address. We use this information to help protect the Site against spam, fraudulent submissions, abuse, and other unauthorized activity, to maintain the security and integrity of our services, to assist with troubleshooting and auditing, and to comply with applicable legal obligations. The country information is derived from your IP address and is used for security and administrative purposes.

How We Retain Personal Information

As a general principle, we keep data in personally identifiable form only for as long as necessary to achieve the purposes for which it is being processed, subject to our reasonable archive, backup, and research practices. In practice, that generally means we may retain your personal information (a) for as long as your account remains active, (b) for as long as you continue to do business with us, or (c) for as long as we are required or permitted to by applicable law. We use industry-standard technological means to protect personal information while in transit through the Internet. We use encryption and a comprehensive authentication protocol to provide reasonable security.

California Privacy Rights

You have the right to request that Paradise Valley Estates disclose to you what personal information we collect, use, disclose, and sell. You may exercise this right following the methods described under the subsection titled "How to Make a Request" below.

Right to Delete Personal Information

You have the right to request that Paradise Valley Estates delete personal information we may hold about you subject to certain exceptions. You may exercise this right following the methods described under the subsection titled "How to Make a Request" below.

Please be aware that we may not always be able to delete your personal information. For example, there may be business or operational reasons why we need to retain personal information. If we deny your request to delete personal information, we will inform you of the basis for our denial in our response to you.

Right to Opt-Out of Sale or Sharing of Personal Information

You have the right to opt out of the sale of your personal information. Because we do not sell personal information, this right does not apply to Paradise Valley Estates.

We may also share your personal information with our advertising or marketing partners to tailor and personalize our offers, ads, and content to suit your preferences while you are browsing other sites. This process may constitute sharing of personal information under certain state privacy laws. It is important to note that opting out only prevents targeted ads using data collected on the browser you opt out on, it does not mean you will no longer see any advertising. You have the right to not receive discriminatory treatment from Paradise Valley Estates for exercising any of your rights described under this "Your Rights" section. This means we will not treat you differently for exercising any of the rights described above. We do not offer financial incentives or price or service differences to consumers in exchange for the retention or sale of a consumer's personal information.

If Paradise Valley Estates is the controller of your personal information and you wish to exercise any of the rights described above, please contact us with proof of identity, as provided in the "How to Make a Request" section. If Paradise Valley Estates is not the controller of your personal information, we will ask you to direct your request to the data controller, and we will reasonably assist the data controller in facilitating the request.

How to Make a Request

You may be required to submit proof of your identity for these requests to be processed as a verifiable consumer request. Such information may include your name, home address, social security number or driver's license. This information will be used only for the purposes of verifying your identity and processing your request. We may not be able to comply with your request if we are unable to confirm your identity or to connect the information you submit in your request with personal information in our possession. You may designate an authorized agent to make a request on your behalf subject to proof of identity and authorization.

We will respond to your request consistent with the CCPA, which does not apply to certain information, such as information made available from government records, certain data subject to FCRA, GLBA and certain other laws, and where its application is preempted by, or in conflict with, Federal law or the United States or California Constitution. In some cases, we may require additional time to complete your request and will inform you if additional time is needed.

If our efforts to resolve your complaint through our internal dispute resolution mechanisms are unsatisfactory, you agree to first attempt to settle in good faith the dispute through mediation administered by JAMS, under its International Mediation Rules. The mediator may propose any appropriate remedy, such as publicity for findings of non-compliance, payment of compensation for losses incurred as a result of non-compliance, or cessation of processing of the personal information who has brought the complaint. The mediation will be held online and all documents and other correspondence will be transmitted through email.

If our efforts to resolve the dispute through mediation are unsuccessful, you agree to binding arbitration administered by JAMS pursuant to the JAMS Streamlined Arbitration Procedure Rules for claims that do not exceed $250,000 and the JAMS Comprehensive Arbitration Rules and Procedures for claims exceeding $250,000 in effect at the time the arbitration is initiated. Judgment on the award rendered by the arbitrator may be entered into any court having jurisdiction over the matter. The arbitration will be held online and all documents and other correspondence will be transmitted through email.

Changes and Updates to this Privacy Policy

Due to the internet's rapidly evolving nature, Paradise Valley Estates may need to update this Privacy Policy from time to time. If so, Paradise Valley Estates will post its updated Privacy Policy on our Site along with a change notice on the Site and the updated revision date. Paradise Valley Estates may also send registered users of our services a notice that this Privacy Policy has been changed. Paradise Valley Estates encourages you to review this Privacy Policy regularly for any changes. Your continued use of the Site and/or services and/or your continued provision of personally identifiable information to us after the posting of such notice will be subject to the terms of the then-current Privacy Policy.
